Kenya's Court bars IEBC from declaring Uhuru president-elect

Kenya’s IEBC has been barred from making a presidential declaration until a petition filled by activist Okiya Omtatah is heard and determined.

The court decision comes off another that allowed Ekuru Aukot to contest in the repeat election.

Activist Okiya Omtatah has obtained temporary orders barring IEBC from declaring Uhuru Kenyatta the president-elect following the withdrawal of Raila Odinga from the October 26 election.

On Tuesday, NASA candidate withdrew from the race and demanded that IEBC calls for a fresh election.

In the ruling delivered Wednesday, afternoon, IEBC has been barred from making any declaration until the petition is heard and determined.

“Pending the hearing and determination of this application and/or the petition herein the Honorable Court be pleased to issue a temporary order of injunction restraining the 1st and 2nd respondents, its agents, servants, or any person claiming to act under its authority from proceeding to announce President Uhuru Kenyatta as the president-elect following the withdrawal of the presidential and deputy presidential candidates representing the National Super Alliance,”

the injunction read in part.

Uhuru’s supporters have been demanding that he be declared president-elect after Raila’s move. The decision to withdraw from the race has thrown a cloud of uncertainty as there is no clear law on such a decision.
